When an employer in Brazil ends a contract without just cause, the law fixes each line of the termination pay. This page works out every line from your salary, dates and FGTS balance, with the projected end date shown.
Saldo de salário. The days worked in the last month, at the monthly salary divided by 30.
Aviso prévio indenizado (Lei 12.506/2011). 30 days, plus 3 days for each full year of service, up to 90 days. When the employer does not give the notice it pays those days, and they still count as service (CLT article 487): the page projects the end of the contract by the aviso days.
13º salário (Lei 4.090/1962). One twelfth of the salary for each month of the year up to the projected end; a month with 15 days or more of work counts whole.
Férias. Unused full periods, plus the incomplete period at one twelfth per month or fraction over 14 days (CLT articles 146 and 147), all with one third more (Constitution article 7, XVII).
FGTS fine (Lei 8.036/1990, article 18). 40% of all FGTS deposits made during the contract, with their interest. Use the balance your FGTS statement shows for the termination fine.
Rescisão por acordo (CLT article 484-A). Half the aviso indenizado and half the fine, 20%; the other lines in full.
Not included. INSS and income tax withholding, so the result is gross; férias owed in double, absences that cut férias, a 13º first instalment already paid, averages of overtime and commissions, resignation and dismissal for just cause. An estimate from the law, not legal advice.
Everything runs in your browser; nothing you type is sent anywhere.
Add the saldo de salário, the aviso prévio indenizado, the 13º and férias proporcionais counted to the projected end, unused férias, a third on all férias, and 40% of the FGTS deposits. On R$4,000 after 5 years and 5 months with R$22,000 in FGTS that is R$23,577.78 gross.
Thirty days, plus 3 for each full year of service in the same company, up to 90 days (Lei 12.506/2011). Five full years give 45 days; twenty years or more give the maximum of 90.
Article 487 of the CLT counts the aviso period as service even when it is paid instead of worked. So the 13º and the férias proporcionais are counted up to the last day worked plus the aviso days, the date the page shows.
Forty percent of all the deposits made in your FGTS account during the contract, with their interest and monetary update. Withdrawals do not lower the base, so use the amount the FGTS statement gives for the termination fine, not the current balance.
Under CLT article 484-A the aviso prévio indenizado and the FGTS fine are halved, so the fine is 20% of the deposits. Saldo de salário, 13º and férias with their third are paid in full, and the worker can move up to 80% of the FGTS account.
The page shows gross amounts, before the INSS and income tax the employer withholds. Which lines are taxed depends on your other income and the Receita Federal rules, so check the net figure on the termination statement (TRCT).
