The Long Service Leave Act 1955 gives 2 months, or 8.67 weeks, of paid leave after 10 years of continuous service with one employer, then 1 month, or 4.33 weeks, for each further 5 years. After 20 years that is 17.33 weeks. Full-time, part-time and casual workers are all covered.
Under 5 years, never. Between 5 and 10 years, only if the employer ends the job for a reason other than serious and wilful misconduct, you resign because of illness, incapacity, domestic or other pressing necessity, or you die. After 10 years, whatever the reason, at 2 months for every 10 years.
The Long Service Leave Act 2018 gives 1/60th of your total period of continuous employment, less leave already taken, once you have completed 7 years with one employer. That is about 6.09 weeks at 7 years, 8.7 weeks at 10 years and 17.4 weeks at 20 years.
Yes, after 7 years. Section 9 of the Victorian act says that when employment ends before the leave is taken, the employee is treated as starting leave that day and the full entitlement is due and payable. Before 7 years there is no entitlement to pay out.
Dean worked part time from 1 November 2009 until his store closed on 1 May 2015, about five and a half years. His employer ended the job for a reason other than misconduct, so he was owed pro rata leave of 4.76 weeks, worked out at 8.67 weeks for 10 years.
At ordinary pay. The Victorian act grants the leave "on ordinary pay", and NSW pays a worker's ordinary pay while on leave or for accrued leave when employment ends. Both acts have detailed rules for averaging variable hours, so this calculator multiplies the weeks by the ordinary weekly pay you enter.
