What counts as overtime. Article 30 calls overtime the time worked beyond the legal maximum, or beyond the agreed week if that is shorter. Article 31 allows at most two overtime hours a day, agreed in writing for temporary needs; hours worked beyond the week with the employer's knowledge count as overtime even without the written agreement.
The legal week. Law 21.561 cuts the ordinary week from 45 to 40 hours in steps: 44 hours from 26 April 2024, 42 hours from 26 April 2026 and 40 hours from 26 April 2028.
The surcharge. Article 32 pays overtime with 50% on top of the salary agreed for the ordinary week. If there is no agreed salary, or it is below the minimum monthly income (553,553 pesos since 1 May 2026), the minimum is the base.
The DT formula. The labour directorate turns the monthly salary into an hourly value by dividing it by 30 (a day), multiplying by 28 (four weeks) and dividing by four times the weekly hours, 168 for 42 hours. The overtime hour is that value × 1.5. For a 42-hour week this is the salary × 0.0083333.
A worked example. The directorate's own figures: a salary of 800,000 pesos gives an ordinary hour of 4,444.44 and an overtime hour of 6,666.67. Ten overtime hours in the month add 66,667 pesos.
Time off instead. By written agreement, overtime can be swapped for up to five extra working days of holiday a year, to be used within six months.
Not included. The proportional minimum for part-time contracts, cycle and averaged schedules, overtime for variable pay, and the tax and contributions on the extra pay.

Divide the monthly salary by 30, multiply by 28 and divide by four times your weekly hours to get the ordinary hour, then multiply by 1.5. Article 32 of the Código del Trabajo sets the 50% surcharge on the agreed salary; the Dirección del Trabajo publishes the formula.
The Dirección del Trabajo gives 0.0083333: multiplying the monthly salary by it gives one overtime hour. It equals 28 ÷ (30 × 168) × 1.5. On 800,000 pesos the overtime hour is 6,666.67 pesos and the ordinary hour 4,444.44 pesos.
Article 31 allows at most two overtime hours a day, and only in work that does not harm the worker's health. Article 32 says overtime is agreed in writing for temporary needs for up to three months, renewable, but hours worked with the employer's knowledge count anyway.
Article 32 says that when there is no agreed salary, or it is below the minimum monthly income, the minimum income is the base of the overtime surcharge. Since 1 May 2026 the minimum is 553,553 pesos, so an overtime hour on 42 hours is at least 4,613 pesos.
Law 21.561, published on 26 April 2023, cuts the week in steps: 44 hours after the first year, 42 hours after the third year, from 26 April 2026, and 40 hours after the fifth year, from 26 April 2028. Fewer hours raise the hourly value of the same salary.
Yes. Since Law 21.561, article 32 lets the parties agree in writing to compensate overtime with extra days of holiday, up to five working days a year, used within six months with 48 hours' notice. Days not requested in time must be paid with the salary.
