This calculator gives the legal minimum indemnité de licenciement for an employee on a CDI in France, from the seniority and the reference salary, with each part of the calculation on its own line. It follows the Code du travail (articles L1234-9 and R1234-1 to R1234-4) and reproduces Service Public's two worked examples to the cent.
Who is entitled. An employee dismissed after at least 8 months of uninterrupted seniority with the same employer, except for faute grave. Seniority counts up to the effective end of the contract, which is the end of the notice period.
The formula. A quarter of a month of salary for each year up to 10 years, then a third of a month for each year from the tenth. An incomplete year counts in complete months: 3 years 6 months on 1,500 € gives 1,312.50 €. Ten years always give 2.5 months of salary.
The reference salary. The law keeps whichever is better for you: the monthly average of the last 12 months, or the average of the last 3 months. In the 3-month average an annual bonus counts only in proportion, so 1/12 of it is added to each month. Turn on "My pay varied" to enter both averages.
Rupture conventionnelle. The indemnité spécifique of a rupture conventionnelle can never be lower than the legal severance pay, and it is due whatever the seniority. Service Public gives no formula under 8 months; the calculator then applies the legal formula to the months worked and says so.
What is not included. Collective agreements often pay more, and the more favourable amount applies. Part-time periods, sick leave before the dismissal and the double indemnity for unfitness of work origin are not modelled. Amounts are gross.

French law gives at least a quarter of a month of gross salary for each year of seniority up to 10 years, and a third of a month for each year from the tenth. Incomplete years count in complete months. On 1,500 € a month, 3 years 6 months give 1,312.50 €, as Service Public shows.
Five years of seniority give at least 1.25 months of gross salary: five quarters of a month. On a reference salary of 2,500 € the legal minimum is 3,125 €; on 2,000 € it is 2,500 €. A collective agreement may set a higher amount, and the higher one applies.
Article R1234-4 of the Code du travail keeps the better of two figures: the monthly average of the last 12 months, or the average of the last 3 months. An annual bonus paid in those 3 months counts only in proportion, so one twelfth of it is added to each of the 3 months.
A dismissal before 8 months of uninterrupted seniority gives no legal indemnity under article L1234-9, unless a collective agreement, the contract or a local custom sets a shorter period. A rupture conventionnelle is different: Service Public says its indemnity is due whatever the seniority.
The indemnité spécifique de rupture conventionnelle cannot be lower than the legal severance pay, or the conventional one when the collective agreement gives more. Employer and employee can agree a higher amount. With 12 years 9 months on 1,500 €, the floor is 5,125 €.
Seniority for severance pay runs to the effective end of the contract, which Service Public defines as the end of the notice period (préavis), not the date of the dismissal letter. Two months of notice can therefore move a seniority of 9 years 11 months past the 10-year mark, where the one-third rate starts.
