Workers in Peru's general private regime receive two kinds of payment twice a year while the job continues. This page works out each one from the law; the settlement when a job ends is on the Peru Liquidación Calculator.
Gratificación (Ley 27735). One monthly pay for Fiestas Patrias, paid by 15 July for January to June, and one for Navidad, paid by 15 December for July to December. If you started during the semester, you get one sixth of your pay for each complete calendar month worked. A start on 10 March counts April, May and June: half a month's pay in July.
Bonificación extraordinaria (Ley 30334). The employer does not pay its EsSalud contribution on the gratificación; it pays it to you instead: 9% of the gratificación, or 6.75% if you are covered by an EPS.
CTS (D.S. 001-97-TR). The compensación por tiempo de servicios is deposited by 15 May for November to April and by 15 November for May to October. The remuneración computable is your monthly pay plus one sixth of the gratificación received in that semester (December's for the May deposit, July's for November). You receive one twelfth of it for each complete month worked in the semester and one thirtieth of a twelfth for each extra day. It starts once you have worked a full month.
Formula. CTS = (pay + gratificación / 6) x (months / 12 + days / 360). Gratificación = pay x complete months / 6.
Not included. The small and micro business regimes, variable pay averages, absences that do not count, and income tax. An estimate from the law, not legal advice.
Take your monthly pay, add one sixth of the gratificación received in the semester, and multiply by the months worked divided by 12 plus the extra days divided by 360. On S/ 3,000 a month for the whole May-October semester the November deposit is (3,000 + 500) x 6 / 12 = S/ 1,750.
In the first 15 days of May, for November to April, and of November, for May to October (D.S. 001-97-TR article 22). It goes into the bank account you chose, not with your salary.
One monthly pay in July and one in December, each for the six months before, plus the bonificación extraordinaria of 9% (6.75% with an EPS). On S/ 3,000 that is S/ 3,270 each time.
The gratificación is one sixth of your pay for each complete calendar month worked in the semester. The CTS counts the months and days from your start date to the end of the semester, once you have completed a first month.
Article 18 of the CTS law adds payments received every six months to the remuneración computable at one sixth of what was received. The gratificaciones of July and December are named in it.
Not as it stands. Micro businesses pay no gratificación or CTS, and small businesses pay half, under their special regime. The page covers the general private regime. Check which regime your employer is registered under before relying on these figures.
