Overtime pay in Peru: 25% for the first two hours a day, 35% after, as the MTPE counts it
Estimates only, not financial advice. What you type stays on your device. Checked against sources on 17 Oct 2026.A worker in Peru earning S/ 1,300 a month for an 8-hour day has an hourly value of S/ 5.42, so each of the first two overtime hours of a day pays S/ 6.77 (25% more) and every later hour S/ 7.32 (35% more). Three extra hours on 10 days come to S/ 208.60.

Read the hourly value, the pay for the first two hours and for later hours, and the total.
This calculator works out the pay for overtime (horas extras or sobretiempo) under Peru's working-hours law, the TUO of Legislative Decree 854, the way the Ministry of Labour's own guide does it.
The hourly value. The guide takes one day's pay as the monthly salary divided by 30 and divides it by the hours of the worker's ordinary working day. With S/ 1,300 and 8 hours that is S/ 5.42. A shorter agreed working day gives a higher hourly value, because the same day's pay is spread over fewer hours.
The surcharges. The first two overtime hours of a day carry a surcharge of at least 25% of the hourly value; every hour after that carries at least 35%. The calculator rounds the hourly value and each surcharge to the céntimo and adds them, as in the guide's example: S/ 5.42 + S/ 1.35 = S/ 6.77, and S/ 5.42 + S/ 1.90 = S/ 7.32. Less than an hour is paid in proportion.
Per day. Overtime is time worked beyond each day's ordinary working day, so the two hours at 25% start again every day. Enter the hours a day and the number of days: three hours on ten days are twenty hours at 25% and ten at 35%.
Agreed rates. The 25% and 35% are minimums. A contract, a collective agreement or company policy may pay more; change both rates under the options.
Other rules. Overtime is voluntary, except for emergencies. It may be compensated with equivalent rest if agreed in writing. Imposed overtime is owed with a 100% indemnity on top. Management staff, intermittent watch work and staff without immediate supervision are excluded.
What it leaves out. The night-work minimum, work on rest days and holidays, and the tax on the payment.

Divide the monthly salary by 30 and by the hours of your working day to get the hourly value. The first two overtime hours of each day are paid with at least 25% more, and every later hour with at least 35% more, under article 10 of the TUO of the working-hours law, D.S. 007-2002-TR.
For an 8-hour day the hourly value is S/ 1,300 / 30 / 8 = S/ 5.42. Each of the first two extra hours of a day pays S/ 5.42 + S/ 1.35 = S/ 6.77, and the third and later hours pay S/ 5.42 + S/ 1.90 = S/ 7.32, as in the Ministry of Labour's worked example.
Per day. Overtime is the time worked before or after the ordinary working day, so every day with overtime starts again with two hours at 25%. Three extra hours on each of ten days are twenty hours at 25% and ten hours at 35%, not two and twenty-eight.
Yes. The Ministry of Labour's guide says that overtime shorter than an hour is paid as the proportional part of the hourly surcharge. Thirty minutes count as half an hour: on S/ 1,300 a month and an 8-hour day, half an hour of overtime pays S/ 3.39.
No, except in emergencies. Overtime is voluntary both for the employer to offer and for the worker to do, unless an unforeseeable event endangers people, property or the continuity of the business. An employer that imposes overtime commits a very serious infraction and owes a 100% indemnity on top of the hour's value.
Yes, if both sides agree in writing. The guide says overtime may be compensated with equivalent periods of rest, given within the calendar month after the work unless agreed otherwise. Without such an agreement the overtime is paid with the ordinary salary on the usual pay day.
