About the Honduras Prestaciones Laborales Calculator

This calculator works out the labour benefits owed when a job ends in Honduras under the Código del Trabajo.

Preaviso. Article 116 sets the notice: 24 hours under three months of service, one week from three to six months, two weeks to a year, one month from one to two years and two months beyond. An employer that dismisses without notice pays the salary for that term (article 118). A day is the monthly salary divided by 30.

Auxilio de cesantía. On dismissal without just cause, article 120 pays 10 days of salary after three to six months, 20 days up to a year, then one month of salary per year with the proportional part. Decreto 150-2008 (La Gaceta 31,753, 5 November 2008) caps it at 25 months, or 15 months in a microenterprise of at most 10 paid employees (article 120-A).

Resigning after 15 years. The same decree added article 120 g): after 15 years or more of continuous work, a worker who resigns receives 35% of that cesantía. It does not apply in a microenterprise.

The salary. Article 123 uses the average salary of the last six months.

Vacation. Article 346 gives 10 working days after the first year, 12 after the second, 15 after the third and 20 from the fourth. Days earned and not taken are always paid; the part of the year in progress is paid when the employer ended the contract (article 349).

13th and 14th month. The fourteenth month covers the year to 30 June. The thirteenth month (Decreto 112-82, articles 10 to 13) covers the calendar year to 31 December. Both are paid in proportion on resignation or dismissal.

What it leaves out. Fixed-term contracts, the notice a resigning worker owes, the pension exceptions of article 120 f), the 75% paid when a worker dies, amounts already paid on account, unpaid salary and overtime.

Decreto 56-2015. Unofficial sources say the Ley Marco del Sistema de Protección Social created a labour-coverage reserve that may be credited against the cesantía the employer pays in cash. Its official copy (portalunico.iaip.gob.hn) did not load for us on 18 October 2026, so this calculator does not apply it. Confirm with the Secretaría de Trabajo y Seguridad Social.

Frequently asked questions

How are prestaciones laborales calculated in Honduras?

On dismissal without just cause the employer owes the preaviso of article 116 (from 24 hours to two months of salary), the auxilio de cesantía of article 120 (a month per year, at most 25, or 15 in a microenterprise), the vacation, and the proportional 13th and 14th month. All are based on the six-month average salary.

How much is the cesantía in Honduras?

Article 120 pays 10 days of salary after three to six months of continuous work, 20 days after more than six months and less than a year, and one month of salary for each year plus the proportional part after that. On L15,000 and 4 years and 242 days that is 4.66 months, or L69,945.21.

How much notice (preaviso) applies in Honduras?

Article 116 sets 24 hours under three months of service, one week from three to six months, two weeks from six months to a year, one month from one to two years, and two months over two years. An employer that dismisses without notice pays the salary for that term.

Do I get prestaciones if I resign in Honduras?

Partly. A worker who resigns receives no preaviso, but is still owed the vacation already earned and not taken and the proportional 13th and 14th month. After 15 years or more of continuous work, article 120 g) (Decreto 150-2008) also pays 35% of the cesantía, except in a microenterprise. The Reglamento of the fourteenth month pays it in proportion on resignation or dismissal, justified or not.

How many vacation days does the Código del Trabajo give?

Article 346 gives 10 working days after one year of continuous service, 12 after two years, 15 after three and 20 from the fourth year on. Days earned and not taken are paid in money when the job ends, whatever the cause, under article 349.

Is there a maximum on the cesantía in Honduras?

Yes. Decreto 150-2008 (La Gaceta 31,753, 5 November 2008) caps the cesantía at twenty-five months of salary, or fifteen in a microenterprise of at most ten paid employees (article 120-A). The Ministry's 2022 compilation still prints the older 15-month text, which the 2008 decree replaced. Decreto 56-2015 may change what the employer pays in cash; its official copy did not load for us on 18 Oct 2026, so it is not applied.
