Which wage counts. Section 108 pays overtime at twice the ordinary rate of the basic wage and dearness allowance, plus any ad hoc or interim wage. House rent, medical, food and transport allowances are left out, so a garment worker's gross wage is not the figure to type: use the basic on the payslip.
The 208 divisor. Rule 102 of the Labour Rules 2015 turns a wage into an hourly rate: one eighth of a daily wage, one forty-eighth of a weekly wage, and one two-hundred-and-eighth of a monthly wage, because 52 weeks divided by 12 months times 48 hours is 208 hours. The overtime pay is then basic × 2 × hours ÷ 208. A contract may agree a different method only if it is not worse for the worker.
How much overtime is allowed. Section 100 allows 8 hours a day, or 10 with overtime. Section 102 allows 48 hours a week, or 60 with overtime, and no more than 56 hours a week on average over a year. Workers in road transport are limited to 150 overtime hours a year. The calculator flags a week above the 60-hour limit.
Who is left out. Piece-rate workers are paid by the piece; section 108(2) says the double rate does not apply to them.
Working an example. A worker on an 8,000 taka basic has an ordinary hourly rate of 38.46 taka and an overtime rate of 76.92 taka. Fifty-two overtime hours in a month come to 4,000 taka on top of the wage.

Overtime is paid at twice the ordinary hourly rate under section 108 of the Labour Act. For a monthly-paid worker the hourly rate is the basic wage with dearness allowance divided by 208, so the formula is basic × 2 × overtime hours ÷ 208, as rule 102 of the Labour Rules 2015 explains.
Rule 102 counts 52 weeks of 48 hours spread over 12 months: 52 ÷ 12 × 48 = 208 hours in a month. A weekly wage is divided by 48 and a daily wage by 8. Dividing the basic by these hours gives the ordinary hourly rate, which is then doubled for overtime.
Section 108 uses the basic wage and dearness allowance, plus any ad hoc or interim wage. House rent, medical, food and transport allowances are not part of it, so overtime is worked out on the basic shown on the payslip, not the gross. A contract may pay on a larger base.
An adult worker may work up to 10 hours a day and 60 hours a week including overtime, under sections 100 and 102, and no more than 56 hours a week on average over a year. Normal hours are 8 a day and 48 a week; road transport workers may do at most 150 overtime hours a year.
No. Section 108(2), as substituted in 2018, says the double rate of section 108(1) does not apply to workers paid on a piece-rate basis, because their pay already follows the pieces they make. A worker paid a fixed monthly, weekly or daily wage gets overtime at twice the hourly rate.
An 8,000 taka basic gives an ordinary hourly rate of 8,000 ÷ 208 = 38.46 taka and an overtime rate of 76.92 taka an hour. Fifty-two overtime hours in a month therefore pay 4,000 taka on top of the monthly wage, under section 108 and rule 102.
