When it is due. Odstupné is due when the employer gives notice, or both sides agree to end the job, because the employer or part of it closes or moves, or the employee becomes redundant (§ 52 písm. a to c). It is also due, at a much higher level, when the employee has reached the highest permitted exposure at the workplace (§ 52 písm. e). Notice for poor health without a work injury, poor results or misconduct brings no statutory odstupné.
How much. At least 1 average monthly earnings when the job lasted less than a year, 2 from 1 year, 3 from 2 years (§ 67). If a working-time account (konto pracovní doby) applied, 3 more are added. For the exposure limit it is at least 12. An earlier job at the same employer counts when the gap was at most 6 months. Many collective agreements pay more.
Average earnings. HR takes the gross pay of the previous calendar quarter and divides it by the hours worked, then multiplies the hourly average by your weekly hours and 4.348 (§ 356). A quarter of 135,000 Kč over 504 hours gives 267.86 Kč an hour and 46,586.21 Kč a month. The average is never below the minimum wage, 22,400 Kč a month for a 40-hour week in 2026, or the matching part for a shorter week.
Tax and insurance. No social or health insurance is paid on odstupné. It is taxed as employment income: the page shows the 15% advance if it is paid on its own in a month, with 23% on the part above 146,901 Kč (3 times the average wage). Paid together with a month's salary it can reach the 23% band sooner.
Paying and repaying. The employer pays it on the next payday after the job ends, unless agreed otherwise. If you work for the same employer again within the months it covers, you repay the matching part (§ 68).
